Hawaii’s No-Fault Law was repealed by the 1997 legislature. The new motor vehicle accident reparations law took into effect on January 1, 1998. This means if you are involved in an accident after 1998, the new law covers your accident.

The new motor vehicle accident reparations law still provides you with medical benefits, without regard to fault. However, the type of medical care you may obtain as the result of an accident, depends on the type of insurance coverage you purchase for your car.

Many of the mandated coverages from Hawaii’s old no-fault law have been made optional under the new law. This means it is very important for you to obtain and retain a copy of your policy declarations sheet. This way, if an accident should occur, you will know the benefits provided by your policy.
